Lögin breyta reglum um samsköttun fyrirtækja þannig að íslensk móðurfélög geti samskattað sig við dótturfélög og útibú sem skráð eru í löndum á Evrópska efnahagssvæðinu eða í Færeyjum. Einnig er heimilað að íslensk dótturfélög undir erlendum samstæðum innan EES eða Færeyja geti notið samsköttunar. Lögin kveða á um takmarkaða samsköttun þar sem móðurfélög geta nýtt rekstrartap dótturfélaga erlendis við tilteknar aðstæður, svo sem þegar félagi er slitið og tap er ónýtanlegt. Lögin tóku gildi 1. janúar 2022 og koma til framkvæmda við álagningu opinberra gjalda árið 2023.
This law amends the rules on group taxation (consolidated tax returns) so that Icelandic parent companies can consolidate with subsidiaries and permanent establishments registered in countries within the European Economic Area or the Faroe Islands. It also allows Icelandic subsidiaries owned by foreign groups within the EEA or the Faroe Islands to benefit from consolidated taxation. The law introduces limited group taxation, allowing parent companies to utilize operating losses of foreign subsidiaries under certain conditions, such as when the subsidiary is liquidated and the loss cannot otherwise be used. The law took effect on January 1, 2022, and applies to tax assessments in 2023 for income and assets in 2022.
